This mobile application is operated by D’bebé Collects, a brand owned by Dixit Suarez Enterprises LLP. Throughout the app, the terms “we”, “us” and “our” refer to D’bebé Collects. D’bebé Collects provides this mobile application, including all information, tools, and services available within it, to you—the user—conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By using our app and/or listing or purchasing products through it, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including any additional terms and policies referenced herein or made available via hyperlinks within the application. These Terms of Service apply to all users of the app, including, without limitation, vendors, customers, content contributors, and browsers.

Please read these Terms of Service carefully before accessing or using our application. If you do not agree to all the terms and conditions of this agreement, you may not access or use the app or any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms.

Any new features, tools, or updates to the application shall also be subject to these Terms of Service. We reserve the right to modify or replace any part of these Terms by updating the content within the app. It is your responsibility to check these Terms periodically. Your continued use of the app following any updates constitutes acceptance of those changes.

SECTION 1 - ELIGIBILITY & ACCOUNT CREATION

By using this app, you confirm that you are at least the age of majority in your jurisdiction, or that you are the age of majority and have given consent for your minor dependents to use the app under your supervision. You agree to provide accurate, current, and complete account information and to update such information as needed. Users must verify their identity via a valid email address and/or phone number before gaining full access to the Service. The Service is available only to users located in India where D’bebé Collects is permitted to operate. Users outside the country may not be eligible to register or transact.

SECTION 2 - PLATFORM USAGE

The platform is provided mainly for the purpose of listing, browsing, buying, and selling products in accordance with our community guidelines. Any other use is prohibited. You may not use the app or any services for any illegal or unauthorized purpose. You agree not to violate any laws, transmit harmful code, or attempt to interfere with the functionality or security of the platform. We reserve the right to suspend or terminate your access if you violate these Terms. We endeavour to keep the Service available at all times, but from time to time the app may be unavailable for maintenance or due to factors beyond our control.

SECTION 3 - USER CONTENT

Content uploaded by users (including product listings, descriptions, images, reviews and messages) remains the responsibility of the user. By submitting content, you grant D’bebé Collects a worldwide, royalty-free, non-exclusive license to use, display, and distribute such content for the purposes of the Service.

We reserve the right (but not the obligation) to review, remove, or modify user content at our sole discretion if it is deemed unlawful, offensive, or in violation of these Terms.

SECTION 4 - PRODUCT LISTINGS & TRANSACTIONS

D’bebé Collects operates a marketplace model, connecting buyers and sellers. While we enable transactions, we do not own, control, or guarantee any product listings. All transactions are between users, and D’bebé Collects does not assume liability for the quality, legality, or delivery of any goods. Sellers are independent third parties and are not our agents or partners. Each user is responsible for any applicable taxes arising from their transactions; D’bebé Collects does not bear any tax liability on transactions between users.

We reserve the right to remove listings or restrict access to the platform in case of suspected fraud, misconduct, or violation of our community guidelines, which are as follows:

• Do provide accurate product information and clear images and videos.
• Do treat other users with respect in all communications.
• Don’t post prohibited or illegal items.
• Don’t manipulate reviews or feedback.
• Don’t infringe third-party intellectual property rights.

SECTION 5 - SUBSCRIPTION & COMMISSION FEES

D’bebé Collects offers subscription models and charges a commission on sales as outlined within the app. We also offer optional premium services—such as featured listings, negotiation on application—which can be availed through premium packages. By listing a product or subscribing to a plan, you agree to the applicable pricing and payment structure. These may be updated from time to time with due notice.

SECTION 6 - THIRD-PARTY SERVICES

We may integrate or link to third-party services or tools. We are not responsible for the content, accuracy, or practices of these services and your use of them is at your own risk.

SECTION 7 - INTELLECTUAL PROPERTY

All content developed or provided by D’bebé Collects, including branding, UI/UX design, graphics, and text, is the intellectual property of Dixit Suarez Enterprises LLP. Unauthorized use, reproduction, or modification of such content is prohibited. You agree not to upload or share any content that infringes on the intellectual property rights of third parties when using integrated services or in your own listings.

SECTION 8 - LIMITATION OF LIABILITY

The D’bebé Collects app and services are provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free service. To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the platform or interactions with other users.

SECTION 9 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless D’bebé Collects, Dixit Suarez Enterprises LLP, and its affiliates, partners, employees, and agents from any claims or demands arising out of your breach of these Terms, your content, or your violation of any laws or third-party rights.

SECTION 10 - TERMINATION

We reserve the right to suspend or terminate your access to the app at any time, without notice, if we believe you have violated these Terms. Your obligations under these Terms will continue even after termination.

SECTION 11 - GOVERNING LAW

These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Return Policy

Return Policy - Buyer

We understand how important it is for you to receive the right product in perfect condition.

Here’s our simple and transparent return policy:

• If the product is damaged upon delivery, we will arrange for collection from your designated address and process a refund to your original payment method within 5–7 working days of receipt.
• If you receive an item different from what you ordered, we will collect the incorrect item and dispatch the correct product at no additional cost.
• For orders containing multiple items, these procedures apply solely to the affected item(s), and the remaining items will remain with you unless a separate return is approved.

Here’s our simple and transparent return policy:

• Return requests must be raised within 48 hours of delivery.
• Returns will only be accepted if:
  • The product is damaged, or
  • You have received a different product than what you ordered.
• To initiate a return, the buyer must provide a proper unboxing video along with clear photos showing the issue.
• Once your request is submitted, we will review your claim within 5–7 business days.
• If your return is approved, we will arrange pickup of the returned product at no additional cost to you.
• You may also choose the self-pickup option, however we will not be responsible for any disputes arising from this transaction. Kindly consider contacting the seller directly.
• If approved, the return must be sent back to the seller.
• Refunds will be processed within 5–7 business days after the returned product is received and verified.

Return Policy - Seller

At D’bebé Collects, we strive to ensure fairness for both buyers and sellers. In case of a return request due to damage or incorrect product delivery, the following process will be followed:

• If a buyer raises a return request claiming the product was damaged or incorrect, the D’bebé Collects team will first contact the seller.
• The claim will be evaluated based on the packing video provided by the seller at the time of dispatch.
• If a valid packing video is available and shows no issues, the return request may be declined.
• If the seller fails to provide a packing video, the product will be returned to the seller.
• In such cases, the seller will be responsible for bearing the return delivery charges.

Sellers are strongly encouraged to maintain proper packing records, including a clear packing video, for each shipment to ensure smooth resolution in case of disputes.

Seller Guide

Welcome to D’bebé Collects! Here's a simple guide to help you get started as a seller:

1. Choose Your Subscription Plan

• Start by selecting a subscription plan that suits your needs.
• Based on your plan, you’ll be able to list a certain number of products on the platform.

2. List Your Products

• After subscribing, you can begin listing your products. By listing products, you represent and warrant that you have full legal title to each item, that you have the right to sell it, and that all information provided is accurate, complete, and in compliance with applicable laws and our platform policies.
• Make sure to share all product details clearly and transparently.
• Products must be gently used and in good condition.
• If there are any dents, marks, or minor damages, these must be clearly mentioned in the listing. If you wish to remove your listing at any time, you may do so via your application under “My Listings”; however, listings with pending or completed transactions cannot be withdrawn without following our dispute resolution process.

3. Set Your Price

• You’re free to decide the price of your product.
• Use our Seller Calculator to help determine a fair and profitable price.

4. Shipping Responsibility

• Sellers are responsible for the delivery charges.
• Ensure the product is safely packed and ready for dispatch once it’s sold.
• Kindly make a packing video to resolve any dispute raised by the buyer.

5. Commission & Platform Fee

• D’bebé Collects charges a commission and platform fee as per your subscription model.
• These charges will be deducted from your payout after a successful sale.

6. Payouts

• Once the product is delivered to the buyer, we’ll process your earnings.
• The payment will be transferred to your account on the 5th of the following month.

7. Product Listing Duration

• Your product will go live once it’s reviewed and approved by our team.
• The listing duration starts from the day of approval, based on your subscription plan.
• You’ll receive a reminder 3 days before your listing expires, giving you time to renew or upgrade your plan for continued visibility.

Please note that by using the D’bebé Collects platform, you may be exposed to content from a variety of users and sources. D’bebé Collects, operated by Dixit Suarez Enterprises LLP, is not responsible for the accuracy, reliability, usefulness, safety, or intellectual property rights of or related to any such content, and you agree to assume full responsibility for your use of or reliance on any content available through the platform.

You further acknowledge and understand that you may encounter content that is inaccurate, offensive, indecent, objectionable, defamatory, or otherwise inappropriate. Should you encounter any content that you believe violates our policies or infringes on your rights, you may report the issue directly to the seller via the contact details provided on their listing, or escalate it to D’bebé Collects by emailing contact@dbebe.in Upon receipt, we will promptly inform the responsible seller and request corrective action.

By using the platform, you agree to waive, and hereby do waive, any legal or equitable rights or remedies you may have against D’bebé Collects and Dixit Suarez Enterprises LLP with respect to such content.
